Equipment provided by MohaveBroadBand.com
MohaveBroadBand.com provides
customers (lessee) with equipment on customers
premise for use only on the MohaveBroadBand.com
network. This equipment remains the sole
property of MohaveBroadBand.com and $1 of the
monthly subscription goes for the rental of this
equipment. Any and all adjustments, repairs,
installation, or moving of equipment by customer
or their representative is strictly prohibited.
Customer agrees to do everything reasonably
within their power to protect the equipment of
MohaveBroadBand.com. In the event that equipment
is damaged or removed from customer premise for
any reason by anybody other than an authorized
MohaveBroadBand.com representative, the customer
agrees that they will be liable for the cost of
replacing or repairing such equipment at the
discretion of MohaveBroadBand.com. The customer
will be charged an installation fee once
equipment is installed and operational.
Equipment is leased on a tenancy basis with a
fixed expiration or return date and the lessee
is required to return the property within
seventy-two hours from the date of failure to
pay any periodic lease payment required by the
lease. Furthermore, the lessee will be charged a
penalty of $5 per day rent on equipment not
returned within the 72 hour limit.
Service Term Information for customers that have
had MohaveBroadBand.com install equipment on
their premise.
MohaveBroadBand.com requires all
broadband installations commit to an initial
service term of at least twelve months in
length. Service terms are automatically be
extended for additional monthly increments at
end of the first years subscription. Service
terms are required to offset associated costs of
service acquisition, installation, and for
MohaveBroadBand.com to maintain innovative
broadband policies and service features for a
sustained period of time. Your initial service
term begins once our vendor declares your
circuit as up and running on the
MohaveBroadBand.com network, referred to as your
Installation or Activation Date.
In the event of a service move
(if you move and have the service installed at
the new location), a new initial service term
will begin again from the date of activation at
the new location. There may be an additional fee
charged to cover the expense of moving our
equipment from your old location to your new
location.
In the event that a customer
requests service be stopped for any reason
before the initial twelve months of service
customer agrees to pay MohaveBroadBand.com the
entire remaining monies that would be payable
had the term been completed within 24 hours of
termination of service.
In order to provide quality
service to our clients and maintain network
efficiency and security MohaveBroadBand may
inspect, reconstruct, analyze, observe, and or
log any & all data moving through the
MohaveBroadBand.com network.
Acceptable Use Policy:
You are ultimately responsible
for any and all activity that originates from
your Internet circuit regardless of your
knowledge of such activity. This includes but is
not limited to activity by other household
members, employees, friends, and guests. This
also applies to security breaches of your own
system by others who launch attacks from your
machine. It is absolutely imperative that
everyone with an Internet connection takes
proper precautions to ensure the security of
their machine. You are liable and accountable
for any activity originating from any of your
MohaveBroadBand.com account services that are
deemed to be in violation of our Acceptable Use
Policy.
MohaveBroadBand.com may
vigorously pursue all instances of abuse. If you
feel you have been attacked or spammed, please
notify MohaveBroadBand.com. In the event of
activity which could be considered deliberately
or otherwise abusive or in violation of this
Acceptable Use Policy, MohaveBroadBand.com
reserves the right to suspend and/or terminate
your account and all MohaveBroadBand.com
provided services immediately without advance
notice.
MohaveBroadBand.com reserves the
right, at its sole discretion, to make a
determination of what constitutes abuse and you
agree that MohaveBroadBand.com determination is
final and binding on you.
The
following activities are considered in violation
of MohaveBroadBand.com’s Acceptable Use Policy:
Intellectual Property Rights Infringement
MohaveBroadBand.com respects the
intellectual property rights granted under the
US copyright laws and the interests of
subscribers and content providers on the
Internet. You may not store material on, or
transmit material over, MohaveBroadBand.com,
Inc.'s information systems or servers in any
manner that infringes the intellectual property
rights of any entity or individual. All notices
received by MohaveBroadBand.com indicating any
activity suspected to infringe upon third party
intellectual property rights will be re-routed
to the primary account holder on file,
accompanied by a request to verify and possibly
cease and desist. MohaveBroadBand.com's policy
of service suspension or termination of members
deemed to infringing the intellectual property
rights of a third party is in accordance with
the Digital Millennium Copyright Act ("DMCA") as
well as US copyright law.
Denial of Service
The use of your connection to
facilitate any activity that deliberately
impairs another entity, individual or machine
from accessing their computer or Internet
connection is in violation.
Hacking
Any member accessing or
attempting to access the machines or accounts of
others or any other attempts to breach the
security of other systems, regardless of success
or failure, is in violation. This also applies
to unauthorized mail or web relay/proxy access
attempts and port scans.
E-Mail Spam
Transmission of unsolicited
e-mail from anywhere within our network,
distributing unsolicited, commercial, email
which advertises any portion of
MohaveBroadBand.com's network, IP or domain
space, hosting content for the purpose of
spamming (such as bulk e-mail distribution
lists) or providing support services (such as
DNS) for anyone intending to conduct such
activity is in violation.
Newsgroup Spam
Posting of messages to
newsgroups that are off-topic or mass posting of
messages to news groups is in violation.
Dissemination of Viruses
Intentional release of malicious
software that is an attempt to cause damage or
harassment to persons and/or machines is in
violation. Additionally, repeated demonstrated
neglect of equipment on the network which causes
malicious traffic or allows unsolicited emails
to be sent to other customers or third parties
is in violation.
Personnel Abuse
Personal threats, sexual
harassment, profanity, rudeness, and vulgarities
of any sort directed toward MohaveBroadBand.com
personnel are considered in violation this EULA
and will not be tolerated. This includes but is
not limited to verbal and or written abuse.
Liability & Limitations
MohaveBroadBand.com is not
liable for any costs, expenses, losses, or
damages, either general, special, actual,
consequential, or incidental, that you may
suffer or that some other person may suffer and
claim against you resulting from the following:
use, misuse, or service outage; customer premise
hardware; your actions or activities, whether
legal or illegal; the actions or activities of
any other MohaveBroadBand.com customer, whether
legal or illegal; or any other goods or services
provided by MohaveBroadBand.com or any of its
vendors. In no event shall MohaveBroadBand.com
be liable to you under this Agreement or in
relation to any matters in any way connected
with this Agreement in an amount that exceeds
the service fee, other than what you have paid
in the preceding month. MohaveBroadband.com will
also not be held liable for the loss of data
resulting from delays, non-deliveries, wrong
delivery, and any and all service interruptions
caused by unforeseeable forces such as war,
terrorism, natural disasters, or other "acts of
God"; or by the negligence of
MohaveBroadband.com/Mustang Communications, its
owners, operators, agents, employees or
sub-contractors.
MohaveBroadBand.com and its
affiliate, contractors, support personnel, or
agents are not responsible for loss of income or
time due to an order not being completed within
the time frame desired, or for any service
outages caused by unforeseeable forces as
described in the previous paragraph.
MohaveBroadBand.com has the right to terminate
your service at any time and at its sole
discretion.
Tech
support
The technical support that
MohaveBroadband provides is limited to
"connectivity" itself and assistance with
configuring your computer and/or browser and
email applications to work with our services.
Support for other applications and uses is not
provided or implied unless it is a specifically
contracted service. MohaveBroadBand does not
provide tech support for your local area
network, printers, scanners, routers, or any
other peripheral device. While these items may
be computer related they are not covered by our
support department. MohaveBroadBand only
provides tech support for browsing the Internet
and email on our email server. MohaveBroadBand
does not provide support for other email servers
or services. MohaveBroadBand.com does not
support all browsers or email applications.
Changes
MohaveBroadBand.com reserves the
right to change this EULA at any time at the
sole discretion of MohaveBroadBand.com
By agreeing to this EULA you
agree that if any portion of this EULA is deemed
unenforceable all other provisions remain in
tact and are still enforceable by
MohaveBroadBand.com. |
